Why did the FDA ban ephedrine?
In February 2004 the FDA issued a final rule declaring dietary supplements containing ephedrine alkaloids adulterated, making them illegal to sell; the rule took effect in April 2004. The agency acted after ephedrine-alkaloid supplements were linked to reports of heart attack, stroke, and death, concluding they presented an "unreasonable risk of illness or injury" under normal use.
Importantly, the ban was written around the ephedrine alkaloids themselves — not the ephedra genus broadly. Is ephedrine legal in 2026?
Ephedrine still exists as a regulated over-the-counter medicine (for example, as a bronchodilator), but it is sold behind the pharmacy counter and its sale is restricted under the Combat Methamphetamine Epidemic Act of 2005, because ephedrine can be used to make methamphetamine. What remains illegal is putting ephedrine alkaloids into a dietary supplement or energy product.
